Bahkan, kritik dari Komnas HAM kepada Pemerintahan Pusat (PP) sejak tahun 2015 tidak pernah direspon positif. Termasuk satu pertanyaan yang tidak pernah terjawab.
“Saya hanya ajukan satu pertanyaan. Tentang kontrak bisnis, antara pemerintah pusat dengan masyarakat Amungme yang hidup di sekitar (tambang) Freeport,” ungkap salah satu komisioner Komnas HAM, Natalius Pigai, Jumat (3/3) malam.
Perspektif dari Komnas HAM itu disampaikan Pigai saat menjadi salah satu narasumber peluncuran buku “Papua Minta Saham” karangan Bupati Mimika, Papua, Eltinus Omangen di Hotel Borobudur, Jakarta Pusat.
Hasil penelusuran Komnas HAM, lanjutnya, tidak ditemukan adanya transaksi jual beli tanah antara pemerintah Indonesia dengan PT Freeport.
Normalnya, kata Pigai, jika memang pemerintah pernah melakukan jual beli tanah, harus ada tranparansi data terkait hal tersebut. Khususnya, terkait akta jual beli tanah atau lahan yang sah secara hukum. Mulai dari lokasi lahan, kesepakatan jual beli antara siapa dengan siapa. Termasuk, keterlibatan notaris hingga nominal yang disepakati dan data lainnya.
“(Kota) New York saja, zaman Anglo Saxon, mereka dikasih gandum sebagai alat tukar. Ini kita (Papua) dirampok. Pemerintah Indonesia dan Freeport, dua-duanya perampok,” tegas Pigai bersemangat.
Dengam demikian, Komnas HAM berkesimpulan secara yakin bahwa Pemerintah dan Freeport terbukti melakukan perampasan hak dan penguasaan tanah sewenang-wenang milik atas tanah di wilayah desa Amungme.
“Jadi, itu bukan tanah tak bertuan,” tuturnya. Sebelum berbisinis, ajak dulu masyarakat adatnya bicara. HAM menjadi aspek partisipasi paling penting dalam kasus ini,” paparnya.
Rencanaya, sejumlah bukti-bukti tersebut, digunakan pihak Komnas HAM untuk menggugat PT Freeport ke Arbitarse Internasional.
Selain itu, Pigai meyakini jika pihaknya dapat berposisi sebagai Quasi Yudisial. Artinya, memiliki kekuatan yang menyerupai orang-orang dari pengadilan atau hakim. Serta mampu memperbaiki situasi atau memberlakukan hukuman hukum pada orang atau organisasi.
“Jika tidak tercapai, lembaga kami akan menjadi Quasi Yudisial,” pungkasnya.
Dalam diskusi dan peluncuran buku tersebut, tiga dari empat narasumber yang diagendakan hadir menyampaikan materinya.
Antara lain, ekonom senior Rizal Ramli, Komisioner Komnas HAM asal Papua, Natalius Pigai, dan peneliti pertambangan Ferdy Hasiman. Satu narasumber lainnya, Menko Maritim dan Simber Daya Luhut Binsar Panjaitan berhalangan hadir.
Selain itu, tampak juga sejumlah tokoh adat suku Amungme, Papua, serta segenap jajaran SKPD Pemda Mimika yang difasilitasi Bupatinya.
Rencananya, PP akan mendesak PT Freeport membagi divestasi saham, sebesad 51 persen.
Dari jumlah tersebut, pihak Papua meminta bagian saham sebesar 21 persen.
