Pakar hukum pidana Universitas Indonesia (UI) Ganjar L Bondan menolak anggapan yang menyebut seluruh bendera Merah-Putih disebut sebagai lambang negara. Soal bendera sebagai lambang negara itu sudah diatur dalam undang-undang.
"Kalau kita bicara mengenai kejahatan terhadap bendera, harus lihat dulu. Harus paham dulu apa itu bendera. Yang utama, di UU No 24 Tahun 2009 Pasal 4, itu disebutkan apa itu bendera. Dan ukuran-ukuran bendera, dan masing-masing keperluannya. Jadi, kalau melihat apa yang ada di pasal 4 itu, tidak semua benda yang atasnya merah bawahnya putih adalah bendera," kata Ganjar kepada detikcom, Minggu (22/1/2017) malam.
"Jadi kita harus lihat dulu, apakah yang warna merah dan putih itu bendera atau bukan. Kalau ternyata bendera, baru ada larangannya. Larangannya termasuk mencoret-coret," sambungnya.
Ganjar pun menyoroti apa yang dilakukan Fahmi dalam aksi membawa bendera yang dilakukannya itu. Dia mengatakan semua tindakan yang menjadi larangan sudah dituangkan dalam ketentuan pidana yang tertera dalam undang-undang.
"Kalau ditulis-tulis dengan maksud melecehkan, masak dia bawa-bawa, dia kibarin? Yang ada dia injek-injek. Tidak semua benda yang atasnya merah bawahnya putih itu bendera," ujar Ganjar.
Menurut Ganjar, ada ukuran yang mengikat dan menjadi ketentuan untuk membedakan bendera yang masuk dalam klasifikasi lambang negara. "Bendera itu rasio panjang kali lebarnya itu, 2 banding 3. Dan ada beberapa ukuran untuk setiap kegiatan, itu diatur. Maka untuk kegiatan tertentu tapi nggak sesuai yang diatur UU kita bisa bilang itu bukan bendera," urai Ganjar.
Kalaupun yang dibawa oleh Fahmi merupakan sebuah bendera, menurut Ganjar, tidak ditemukan maksud melecehkan dari kegiatan itu. Dia pun menyayangkan penahanan yang dilakukan polisi terhadap Fahmi.
"Ditahan menurut saya berlebihan. Di kasus itu, menurut saya, itu bendera, bendera itu ada lafaz Arab ya. Apa iya menuliskan lafaz Arab itu di bendera merah putih niatnya untuk melecehkan, merendahkan, menghina bendera kebangsaan? Menurut saya tidak," tuturnya.
"Jadi dalam kasus itu, menurut saya, tidak ada tindak pidananya. Karena tidak ada tindak pidananya, nggak ada yang bisa jadi tersangka, nggak ada yang harus ditahan," sambung Ganjar.
Dalam UU No. 24 tahun 2009 pasal 4 disebutkan:
(1) Bendera Negara Sang Merah Putih berbentuk empat persegi panjang dengan ukuran lebar 2/3 (dua-pertiga) dari panjang serta bagian atas berwarna merah dan bagian bawah berwarna putih yang kedua bagiannya berukuran sama.
(2) Bendera Negara sebagaimana dimaksud pada ayat (1) dibuat dari kain yang warnanya tidak luntur.
(3) Bendera Negara sebagaimana dimaksud pada ayat (1) dibuat dengan ketentuan ukuran:
a. 200 cm x 300 cm untuk penggunaan di lapangan istana kepresidenan;
b. 120 cm x 180 cm untuk penggunaan di lapangan umum;
c. 100 cm x 150 cm untuk penggunaan di ruangan;
d. 36 cm x 54 cm untuk penggunaan di mobil Presiden dan Wakil Presiden;
e. 30 cm x 45 cm untuk penggunaan di mobil pejabat negara;
f. 20 cm x 30 cm untuk penggunaan di kendaraan umum;
g. 100 cm x 150 cm untuk penggunaan di kapal;
h. 100 cm x 150 cm untuk penggunaan di kereta api;
i. 30 cm x 45 cm untuk penggunaan di pesawat udara; dan
